Yes he was already assaulted but in the absence of the looser new law he would have had to let them pretty much get done mugging him before he could have used forceful measures. Now the law allows for one to use forceful measures if you can reasonably show a real potential threat. Deadly force is included in the new law where before you REALLY had to have some specific circumstances before you could shoot.
Under the old law you had to have someone actually break into your home and you had to shoot them INSIDE of it to have a justifiable shoot. As well, you couldn't shoot them unless they were fully facing you and damn sure not in the back!
Now you can be anywhere including in public and have grounds for proving justification. Shooting them in the back (indicating they were fleeing) is still somewhat questionable but not excluded from justification.
