Turns out our newest registrant is the administer of Mock! "arsehole" AKA Kevin Hannan has sent me a letter trying to be slick with me when I demanded that my credits be put back, pay me my removal fee or find a new theme.

What is wrong with these people? The hostility is absurd.

Dear Sirs,

You have recently made contact with "Mock Forums" (www.mockforums.net) demanding payment
for a skin you say you have created.

I shall be handling this matter on behalf of "Mock Forums" and any subsequent communication by you
or your representatives to "Mock Forums" must be made only to me. Failure to do so may result in a
complaint of Harassment to an appropriate Law Enforcement Authority without further notice to you.

In the first instance I shall need to see a signed copy of the original contract. You may send me this
via email in the first instance within five working days otherwise we shall consider the matter closed.
In the event there appears to be a valid contract, I shall need to see first-hand either the original signed
contract or a copy with a sworn affidavit that an official third-party has seen the original (i.e. Law office official).

Oh I see we're going to play this game.
Frank (middle finger) owned the site when I had done two full weeks worth of work for him. If you hadn't deleted my account there (The Antagonist) You could go back and see all the posts regarding the work I have done.

I have no signed contract. I have a verbal contract from Frank and I have a list of Skype conversation history made between me and Frank when said work was done. Frank giving the site to Elisabeth does not negate said contract.

Hostility toward me is ridiculous. Whatever animosity Duchess has toward me is certainly not reciprocal. In fact, she's a member in good standing on one of my sites for a couple of years now. Other than the nonsense that went on between me and Frank, I don't know what the problem is there with me or the need to delete my membership. I assure you I have no intention of visiting the site as a member. Threats of harassment is a bit extreme, don't you think?

I have copies of the theme.
I have copies of your old database.
I have copies of artwork done for the site.

You can check with Elisabeth (Duchess) that I have done such work and I hope she does not pretend ignorance on this.
I hope this information will do. Would you like copies of the databases and stuff?
I can also give you old admin login info that was to access the servers when Frank had the site. They are defunct now, of course.

I also noticed you have joine my site as "arsehole" on 8/1/2010 at 9:03 AM EDT. Please feel free to make your introduction and post. We prune 0 posters monthly. Or were you just stalking me? (see? threats can go two ways if one is creative with the wording.)

Ah, an update!

Dear Ma'am,

You state you have no specific contract with Ms Sears to make your claim with.
There is also no contract with any previous owner(s) of "Mock Forums" to perpetuate any
contractual conditions to Ms Sears.

Any contract , verbal or otherwise, is therefore with another person. I suggest strongly
that you discuss your options with your legal consultancy.

This communication is final and any further progression of this matter will have to be determined
in a relevant Court of Law or Arbitration at your cost entirely. You may forward to me only any
formal papers to the same within the statute time-scale.

Ms Sears does not wish any further direct communication from you or your representatives.
Failure to comply may result in complaints to both the Law Enforcement Authority and/or your Internet Provider
and Webspace Provider of some or all of harassment and demanding remuneration without due cause
without further reference to you. Copies of our email exchange will accompany any complaint made.

Go right ahead and sue me. Have at it and I will reverse it. Sue me in the UK too. I have a lawyer there as well.

Any contract made with Frank D'Aurio who owned the site previously carries over to Ms Sears. Check your US law.

This forum war crap is quite childish. You spent 15 minutes on my site. Did you find what you needed or do you need me to help facilitate that? I'm forwarding this to my attorney now.

All I ask is you put the credits back or get a new theme. Considering I have done artwork for Ms. Sears in the past I find this whole thing ludicrous.

TOS on use of my themes is posted all over my site. You might want to check that too.

I just sent another letter (hoping to get sued?) with a copy of my TOS for free themes.

I'll attach the TOS for you guys to read too.

I am attaching a copy of the TOS for the free themes that are on my site. This theme is considered a free theme since it was not paid for.
Regardless whether there was a specific contract or not between Ms Sears and myself, the TOS of this applies.

It is not my problem that Frank never forwarded this to her.
It is included with every theme download AND custom theme packets.

What is the problem about putting the linkback and credit where it was or complying with replacing the theme if you do not want to pay for the removal? If you don't believe me that this is SOP with my stuff, simply join SCD and download a free theme once you follow the requirements of membership and post your intro.

Those who know just enough to dangerous are those who are so quick to threaten litigation. The fact is that the knowledge they DO have is incomplete and 99 out of 100 times the missing info is just what makes their threats of legal action nothing more than frivolous airclaims!

And just to make it PERFECTLY CLEAR - if it weren't for ME keeping the database when I made the site over for Frank, there would be no mock.

Frank wouldn't give access to Dylan when the site was being moved, along with him keeping the domain name for himself forcing her to go .net.
I had to give Dylan the copy of the database I had so the transition from Frank to Duchess could happen.

Not a thank you.
