I think the guy will win the case. I don't see how someone can foreclose on a property fully owned and no mortgage. If anything they should sue for the HOA fees past due and that's all.
The wife's depression really isn't an excuse for not paying. She's married and has benefits she could have utilized. Her parents were involved and nothing stopped them from opening a letter or helping her. Certified letters need to be signed for, so who signed and why didn't anyone check these things? Someone paid the other bills didn't they?
It's a mess all around and shouldn't have happened. Plus the Servicemembers Civil Relief Act will come into play when it's revealed in court the HOA completely ignored it.
